Fraser Milner (Randy Hughes, John Lorne McDougall, Q.C., and Susan Paul) is acting for Bayer Inc. and Bayer Corporation in a class action which is the first and only class ever certified in a competition case in Canada. It is also the largest class action ever certified with an estimated class size of 1.1 million Canadians. The claim relates to the price of iron oxide sold in Canada from 1984 to 1992. Iron oxide is used to colour some concrete building materials and the class certified is a class of “end users” including home owners and owners of other buildings. Leave to appeal the certification order to the Divisional Court was granted October 7. Joel P. Rochon and Vincent Genova of Rochon Genova represented the certified class.
