Tom Cumming is a partner and leader of Gowling WLG’s restructuring and insolvency practice in Calgary. He acts for financial institutions, creditors, interim (DIP) lenders, court officers, purchasers and corporate debtors in matters involving the oil & gas, commercial real estate and development, manufacturing, technology, shipping and agricultural industries, and in the indigenous space. Tom has represented clients before all levels of courts in CCAA, proposal, receivership and bankruptcy proceedings, and in the restructuring, financing and purchase and sale of distressed businesses. He is ranked by Chambers Global and Lexpert®. Between 2015 and 2018, Tom represented Grant Thornton Limited at the Supreme Court of Canada, the Alberta Court of Appeal and the Court of Queen’s Bench of Alberta in Orphan Well Association v Grant Thornton Limited and Re Redwater Energy Corp, where the regulator challenged the protections against environmental liabilities available to receivers and trustees, the relative priority of environmental regulatory claims against secured creditor claims, and the ability of receivers to sell assets of petroleum producing companies. In the late 90s, Tom advised the government of Russia in connection with the reform of its bankruptcy law.
