Byron Shaw is a partner in McCarthy Tétrault LLP’s Toronto office. His practice includes class action defence, corporate and commercial litigation and public law. Byron has appeared before all levels of court in Ontario, courts in other provinces, and the Supreme Court of Canada. Byron frequently acts for pharmaceutical companies in product liability matters concerning medical devices and prescription and over-the-counter medications. He was counsel to the defendants in the AndroGel® testosterone litigation, the first pharmaceutical class action to be defeated on summary judgment in Canada. Byron acted for Sanofi in ranitidine litigation, obtaining a dismissal of proposed national class actions concerning allegations that Zantac® causes cancer. Byron has also defended companies in litigation concerning opioids, hernia mesh, cardiac devices, and weight loss medications. Byron has significant experience in consumer protection matters. He acted for trivago in its successful defence of a proposed national class action concerning allegedly unlawful business practices. He has also acted for banks and individuals in securities misrepresentation claims. Byron has published or co-published leading texts and articles and his academic work is frequently cited by Canadian courts.
