James Green is an intellectual property litigator in Gowling WLG's Toronto office. He has extensive experience representing clients in trademark, patent, design and copyright litigation before all levels of court in Canada. His recent experience includes four of only a handful of Canadian trademark cases where claims of depreciation of goodwill (dilution) have succeeded, as well as the successful prosecution of contempt of court proceedings leading to rare prison sentences against repeat infringers. James has particular experience in Canadian opposition and cancellation practice, including wins in a series of complex opposition proceedings before the Trademarks Opposition Board dealing with non-traditional trademarks. He also assists brand owners with the recovery of improperly registered domain names under the UDRP and CDRP domain name complaint processes. In addition to enforcement work, James is a registered Canadian trademark and patent agent and provides advice to Canadian and international clients with respect to intellectual property strategy, clearance, and prosecution. Before law, James studied chemistry.
