Jay Zakaïb is an intellectual property litigation partner in Gowling WLG's Ottawa and Montreal offices. Technically trained as a chemical engineer and legally trained in civil and common law, he has represented innovators and brand owners before trial and appellate courts, administrative tribunals, and regulatory bodies in both official languages for over 20 years. He has enforced patents, trademarks, copyrights, trade secrets, and plant breeders’ rights; defended competition law claims; and handled judicial review of administrative decisions issued by the registrar of trademarks, the commissioner of patents, and the ministers of health, industry, and the environment. The primary focus of his practice is patent litigation, mainly in the life sciences, material sciences, petrochemical, manufacturing, and agri-food industries. He has also acted on a variety of trademark litigation cases dealing with the validity and enforceability of brand owners’ trademark rights. As a patent agent, he advises clients on managing patent prosecution, regulatory requirements, and data protection strategies to secure appropriate product protection. He has been recognized in Chambers Global, Chambers Canada, IAM Patent 1000, and the Legal 500 Canada.
