Karen MacDonald's practice covers litigation in all areas of intellectual property, with an emphasis on trademark litigation and brand enforcement. She has appeared before the Federal Court, the Federal Court of Appeal, the BC Supreme Court, and the BC Court of Appeal, with extensive experience in advising clients on IP litigation strategies, conducting examinations, engaging in effective and efficient written advocacy, preparing, and presenting arguments in Court, as well as conducting effective settlement negotiations. Offers particular experience in the field of anti-counterfeiting. Heavily involved with developing and implementing anti-counterfeiting enforcement programs in Canada for major international brands, including advising on civil strategies in precedent-setting cases, operating in fields such as luxury goods, apparel, and certification marks. Trademark prosecution is another significant element of her practice. Advises both Canadian and international clients on filing strategies and global portfolio management, regularly filing applications and preparing responses, and appearing before the TMOB in oppositions and summary expungement proceedings.
