Michael Burgar is a trial and appeal lawyer who has worked on thousands of litigation cases over 31 years. The claim was settled after one day of discovery of the defendant's CEO for the amount sought in the statement of claim, plus costs ($2.9 million all-inclusive). (2) Stewart v. Demme, 2022 ONSC 1790 (Div Ct), 2020 ONSC 83 involved a successful defence appeal and decertification of a class action on behalf of a hospital nurse sued for intrusion upon seclusion (invasion of privacy). This class action was decertified. Ten individual actions were all dismissed. (3) Gallagher v. Todish, 2023 ONSC 4894 involved a successful summary judgment motion on behalf of an auto insurer upholding the termination of an auto policy.
